ADVANCE PAYMENT of half of the rental rate, security deposit and this signed lease agreement must be returned to Owner as soon as possible to communicate to Owner to reserve the Property. Acceptable forms of payment include; personal check, money order and certified check. A $35.00 handling fee will be charged for all returned checks. 2. BALANCE DUE must be received by Owner 30 days prior to arrival. If the balance is not received 30 days prior to arrival, a late fee of $100.00 will be added to the balance due. Acceptable forms of payment include; personal check, money order and cashiers check. A $35.00 handling fee will be charged for all returned checks. For reservations made less than 30 days from check in, all funds, or total as shown above are due and payable by money order or certified check. All reservations must be paid in full prior to possession of the premises. 3. PETS ARE NOT PERMITTED IN THE RENTAL PROPERTY unless a pet agreement is signed. Violation is a material breach and is grounds for immediate eviction. No exceptions – No refunds. 4. TENANT shown above acknowledges that he/she is at least 25 years old and understands that he/she must personally occupy the property for the entire period. Tenant further acknowledges he/she may not rent the property in connection with a non-family use such as high school, college, or civic groups and to do so constitute a material breach, which would be grounds for immediate eviction. No refunds. 5. CANCELLATIONS must be made in writing and received by Owner 30 days prior to check in. Refunds are available if the property is re-rented. The tenant is responsible for verifying that the Owner has received the cancellation letter. If Owner is unable to re-rent the property, any and all prepaid rental payments and deposit will be forfeited. If the property is re-rented for full term of the original rental period, Tenant will receive a refund of any prepaid rental payment, less a service charge of $75.00. If the property is re-rented for part of the original rental period, the refund will be prorated, less a service charge of $75.00. Refunds will be payable to the Tenant within 30 days after the subsequent re-rent payment has cleared our account. |
| SAMPLE page 2 6. SECURITY DEPOSITS are required to secure the faithful performance of Tenants promises and duties contained herein. Tenant covenants and promises to surrender the property in as good and the same condition as of commencement of the rental period, and to reimburse Owner any amount above the security deposit when it is disposed of including attorney’s fees for all damages. Owner will inspect the property upon Tenants departure and deduct all costs for damages due to extra cleaning, repairs or replacement. Deposit will be refunded within 30 days of check-out. 7. DAMAGES to the Property during the occupancy are the Tenants responsibility and must be reported to Owner immediately and paid for prior to departure. If the cost of the damages is undetermined by the time of departure, the tenant shall remain responsible for such costs and agrees to pay promptly when notified by Owner of assessed amount. Re-arranging of furniture is not permitted. Tenant must leave property clean and ready for the next guest. All dishes must washed and put away, all food removed from refrigerator(s) and wiped clean, all trash removed from home, all used linens and towels must placed in laundry room, and floors swept or vacuumed prior to departure at check out. 8. INSPECTION AND REPAIRS to property, its fixtures, appliances, furnishings, and facilities during the rental period may be made by Owner at anytime with-in reason. 9. CHECK IN for Property is not before 1:00 PM on the arrival date. Tenant will meet owner at cottage for keys at check-in. Tenant will convey to owner if check-in / arrival will be later than 1:30 PM. 10. CHECK OUT on the day of departure will be no later than 10:00 AM. Tenant will complete and sign check-out sheet before departure. 11. LIMITATIONS OF REMEDIES, DAMAGES AND INDEMNITY a) In the event that the Owner is unable to allow the Tenant the use of said Property because of fire, act of nature, mandatory evacuation, double- booking, or any other reason whatsoever, Tenant hereby agrees that Owners sole liability as a result of any such condition is a refund of the prorated rental for each night Tenant is unable to use the Property. b) Tenant understands that there are inherent risks associated with any property, including risks associated with any special feature, such as hot tub, decks, elevator, etc. Tenant certifies that they are thoroughly familiar with how to properly use the premises, including all special features included therein or thereon. Tenant will be responsible to explain how to use each and every feature of the dwelling to Tenants guest. Tenant agrees to release and indemnify the Owner from and against all liability, should anyone be injured upon the premises during the term of this lease, resulting from any cause whatsoever, except in the case of a personal injury caused by the negligent act of the Owner, and Tenant further agrees to indemnify and save harmless Owner from any claims made by Tenant or Tenants guest for injury and liability to person or property. Tenant further agrees that tenant is responsible and liable for, and will pay upon request, any damages that occur to the premises or any portion thereof due to Tenants and/or his guest’s misuse and /or negligent use of the premises or any portion thereof. c) Tenant shall not be entitled to any refund or rebate due to acts of nature, delay in check in, unfavorable weather, disruption of utility services, malfunctioning or missing equipment/appliances/furnishings, surrounding construction and associated noise, empty propane gas cylinders for gas grills or any other situation occurring not under Owners control. Tenant covenants and agrees to vacate upon a mandatory evacuation order or at Owners sole discretion, deems it in the best interest of the Tenant to vacate. d) Every effort to insure that the information in this agreement is correct. However, we will not be responsible for any errors contained herein. 12. Smoking permitted outside only.
